Welcome to ElderMate. These Terms of Service ("Terms") govern your use of the ElderMate mobile application and services operated by Pard Business Management & Consulting Ltd. (“us,” “we,” or “our”). By using our Service, you agree to these Terms.

1. MEDICAL DISCLAIMER AND EMERGENCY NOTICE

ELDERMATE IS NOT A MEDICAL DEVICE.

For Awareness Only: The Service is intended for general wellness and family coordination. It is not designed to diagnose, treat, or prevent any medical condition.

Emergency Situations: Do not use ElderMate as a primary emergency response system. In the event of a medical emergency, immediately contact your local emergency services (e.g., 911).

Reliance on Data: Any health data synced via Apple Health or Google Fit is for informational purposes. Users should always consult a licensed healthcare professional before making any medical decisions.

2. SERVICE AVAILABILITY AND LIMITATIONS

Deterministic Logic: ElderMate uses a rule-based engine to trigger alerts. While we strive for 100% reliability, you acknowledge that the Service depends on third-party factors (e.g., Apple/Google APIs, internet connectivity, and hardware sensor accuracy).

"As Is" Service: The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, timely, or error-free.

Third-Party Hardware: We are not responsible for the accuracy or failure of wearable devices (Apple Watch, Fitbit, etc.) used in conjunction with the App.

3. USER RESPONSIBILITIES

Account Security: You are responsible for maintaining the confidentiality of your account and ensuring that only authorized family members have access to the "Hub" interface.

Data Accuracy: You acknowledge that manually entered data or permissions granted to sync health data are under your control and responsibility.

4. SUBSCRIPTION, PAYMENTS, AND REFUNDS

Crowdfunding Rewards: Licenses obtained via Indiegogo are subject to the terms of that platform.

Store Purchases: Subscription fees and in-app purchases are processed through the Google Play Store or Apple App Store.

Refunds: Refunds are governed by the respective store’s policies. To request a refund, please follow the procedures outlined by Google or Apple.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Pard Business Management & Consulting Ltd. shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to, health complications or failure to receive alerts, arising from the use or inability to use the Service. You use ElderMate at your own risk.

6. INTELLECTUAL PROPERTY

All software, design (including the "Zen Mode" and "Hub" interface), and proprietary underlying architectures are the exclusive property of Pard Business Management & Consulting Ltd.

7. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.
